The Poison Prevention Packaging Act (PPPA), which is enforced by the Consumer Product Safety Commission (CPSC), is the main law governing child-resistant packaging for consumable goods in the United States. Certain products must be packaged in a way that makes it extremely difficult for children under five to open while still being accessible to adults in accordance with the PPPA.

Beyond federal standards, many states have layered on their own packaging requirements, especially for hemp-derived and cannabis-adjacent products. These state-level rules often go further than the federal baseline, adding requirements around:

• Opaque or non-transparent packaging (so products aren’t visible to children)
• Resealability: the packaging must remain child-resistant after the first open
• Clear labeling that identifies the product as intended for adults only
• Specific warning language on the label

In short, it’s not enough to just slap a child-resistant cap on something. The entire packaging system has to meet the standard, and it has to keep meeting it throughout the product’s shelf life.

What “Child-Resistant” Actually Means (Technically)

You might assume any package that’s hard to open qualifies. Not quite. Under CPSC testing protocols, child-resistant packaging must pass a standardized panel test:

• At least 85% of kids between the ages of 42 and 51 months are unable to open the package in five minutes, both with and without assistance.
• Within five minutes, at least 90% of adults between the ages of fifty and seventy can correctly open and close the package.

That’s the official benchmark. It’s not about making things impossible to open. It’s about creating meaningful resistance that buys time and reduces accidental access.

• Never leave open packages on a counter or coffee table
• Keep products in their original packaging. Don’t transfer to unmarked containers
