Because of this, the Florida Department of Agriculture and Consumer Services (FDACS) has been actively enforcing Florida's total-THC standard, including stop-sale orders and product seizures during 2025.

Important: Upcoming Federal Hemp Law (Effective November 12, 2026)

A federal law enacted in November 2025 (P.L. 119-37) redefines "hemp" using a total-THC standard and caps finished hemp products at 0.4 milligrams of total THC per container. This change is scheduled to take effect on November 12, 2026, and applies in every state, including Florida. Industry analysts expect it to make most high-THCa flower non-compliant once it takes effect. The law is being challenged by hemp-industry groups, so the final outcome may change. We recommend customers stay informed and verify current compliance before ordering.
