Under HB 1045 (2021) and SB 2096 (2023), synthetic, converted, and isomerized cannabinoids — Delta 8, Delta 10, HHC, THC-O, THCP are excluded from the hemp definition entirely.
North Dakota goes further than most states. State guidance limits naturally-occurring Delta 9 to 5 mg total THC per serving with a Total CBD to Total THC ratio greater than 15:1, and treats Delta 9-only edibles as psychotropic products not permitted at retail. Our Delta 9 gummies, caramels, taffy, and syrup are formulated at 10 mg per piece above what North Dakota allows. We do not ship them there.
