Virginia’s Total THC Standard

Most states measure Delta-9 THC alone. Virginia’s approach is different. Under legislation passed in 2023, Virginia limits total THC in retail hemp products and caps total THC at 2mg per package, with a narrow CBD-to-THC ratio exception for higher-CBD formulas.

Important update: That ratio exception is being phased out. Starting August 15, 2026, Virginia is eliminating the 25:1 CBD-to-THC allowance; any hemp product exceeding 2mg of total THC per package, regardless of CBD content, will no longer qualify as a legal retail hemp product in the Commonwealth. Enforcement is also shifting from VDACS to the Virginia Cannabis Control Authority around the same time.
