Senate Bill 57, signed July 30, 2019, is the foundation. Hemp and hemp-derived products were decriminalized in Ohio, the federal THC threshold was adopted as the state standard, and CBD could be sold outside medical marijuana dispensaries.
Ohio Revised Code Section 928.01 defines hemp and, by extension, CBD as containing no more than 0.3% total THC (including THCA), derived from hemp. Senate Bill 56 updated this to a total-THC standard, putting Ohio ahead of the federal total-THC rule that takes full effect nationwide on November 12, 2026.
What Senate Bill 56 Changed
SB 56 took effect in March 2026 and is the most common source of confusion in Ohio right now.
It changed the law to prohibit the sale of intoxicating hemp products outside licensed marijuana dispensaries, primarily Delta-8 and THCA. Testing, packaging, and 21+ age requirements apply to these products as well as recreational marijuana.
CBD that is not intoxicating was not changed. The purchase, sale, and possession of oils, gummies, topicals, capsules, and flower under the 0.3% total THC threshold remains fully legal. It is not necessary to have a license or medical card. Ohio-compliant CBD can still be shipped online by online retailers.

What Changes November 12, 2026
Ohio is already ahead of the curve here. Since March 20, 2026, Senate Bill 56 has capped hemp products at 0.4 mg total THC per container and applied a total-THC standard. On November 12, 2026, that same 0.4 mg total-THC-per-container cap becomes federal law nationwide bringing the rest of the country up to the standard Ohio has followed for months.
