Purchase CBD in Idaho

Ensure that the product has a Certificate of Analysis. CBD Idaho’s rules are among the strictest in the country. In Idaho, CBD is legal only if it contains 0.0% THC, not the 0.3% allowed federally. Full-spectrum products, hemp flower, and pre-rolls do not qualify. Only CBD isolate products with a lab report showing zero THC are legal to buy, possess, or ship into Idaho.
Idaho passed HB 126 in 2021, which allowed hemp cultivation under a state license. But the Idaho State Department of Agriculture requires finished hemp products sold in-state to test at 0.0% THC. Cultivation and retail follow different standards.
Idaho has no medical marijuana program. The only prescription CBD medication is Epidiolex. Idaho State Police have seized hemp shipments moving through the state, so this is enforced, not theoretical.
Non-compliant CBD products under 3 ounces are a misdemeanor, punishable by up to a $1,000 fine and a year in jail. As of January 1, 2026, Idaho also enforces a mandatory minimum $300 fine on top of that, judges can no longer waive it, so the stakes just got higher.
