Total-THC standard. Georgia measures compliance using total THC, (THCA × 0.877) + Delta-9 THC, which must stay at or below 0.3% dry weight, not just Delta-9 alone.
Upcoming federal change. A federal law signed on November 12, 2025 (P.L. 119-37, Section 781) redefines hemp effective November 12, 2026. The new definition uses a total-THC standard that counts Delta-8, caps finished products at 0.4 mg of total THC per container, and excludes synthetically derived cannabinoids like Delta-8. Because most commercial Delta 8 is made by converting CBD, the vast majority of today&#8217;s Delta 8 products will fall outside the federal definition of hemp once this takes effect, unless Congress amends the law. Legislation has been introduced to delay or revise the change, but none has been enacted.
